The online shop of the www.casaalegre.com site shall be governed under the terms and conditions set out here, which the Customer agrees to comply with.

VAA is the promoter and manager of the website www.casaalegre.com, hereinafter designated “Casa Alegre”.

VAA is the promoter and manager of the website www.casaalegre.com, called "Casa Alegre". With the exception of “VAA Brand” products (including the name “Vista Alegre” or other names such as “Casa Alegre”, “Bordallo Pinheiro”, “Cook & Serve” and “Cerutil”, Bordallo Pinheiro and Casa Alegre), VAA is merely an intermediary in online marketing between the Partner selling the products and the Customer.

2. PRICES AND PRODUCTS

The Casa Alegre website is dedicated to online sales of products from various sectors of the Portuguese home sector, including gourmet food products, fashion accessories and Portuguese tourist accommodation.

Products with alcohol content (such as wines, spirits, liqueurs ...) available for sale on the Casa Alegre website can only be purchased by people who are of legal age to consume alcoholic beverages in their country and/or wherever the person is living. When in doubt, contact Customer Service.

The prices in the catalogue of Casa Alegre site are in Euros and include VAT at the legal rate in force at the time of the purchase, to which the delivery cost must be added.

The prices and product specifications contained in this site may be changed by VAA, without prior notice.

3. PLACING AN ORDER

The possibility of placing orders on the Casa Alegre website online store is restricted to orders to delivery and billing addresses in mainland Portugal or in the Autonomous Regions of the Azores and Madeira.

Orders for delivery to PO Boxes are not accepted.

3.1 VAA Products

Products presented with "VAA Brands", including the name "Vista Alegre" or other names such as "Casa Alegre", "Bordallo Pinheiro", "Cook & Serve" and "Cerutil" are limited to existing stock. In the event of unavailability of any item, VAA will inform the Customer.

For some products, duly identified, the order may be limited to a certain number of copies.

3.2 Products from our Partners

These products will be shipped directly by the Partners and are limited to existing stock. In the event of unavailability of any item, VAA will inform the Customer.

The Partner undertakes to guarantee the delivery of its products to the Customer, fulfilling the deadline(s) previously indicated on the website.

3.3 Customization of Products from our Partner

In case the Customer intends to order products from the Partner with changes and/or customizations, he/she should contact Customer Service of the Casa Alegre website. An estimate will be presented to the Customer, which, in case of acceptance, the request will be carried out with the partner and the Customer will be billed by VAA.

4. DELIVERY OF THE ORDER AND SHIPPING COSTS

We are taking heightened measures of hygiene and safety in the entire process of packing orders.

All orders confirmed by VAA will be delivered to the address specified by the Customer for delivering the order.

  4.1. Home delivery by VAA or Partners

All orders paid and confirmed on the Casa Alegre website will be delivered to the address that the Customer specified for delivery at the time of ordering.

After order confirmation you will receive:

- A first email and SMS informing you that your order has already been collected by the carrier at our facilities. In that same email you will be able to check the tracking number and a link will also be made available allowing to change the address and delivery date (changes in delivery will be charged by the carrier). Only valid for mainland Portugal

- A second email and sms informing that your order has been shipped, including information on the date and period of delivery. In that same email you will be able to check the tracking number and a link will also be made available allowing to change the address and delivery date (changes in delivery will be charged by the carrier).

- About 30 minutes before delivery, you will be contacted by telephone by the carrier.

In the event of problems with delivery to the Customer (such as non-delivery due to loss and/or misplacement ...), the Customer Support Service of the Casa Alegre website should be informed.

5. TIME OF DELIVERY

The estimated delivery time is defined on the page of each product. This period includes the time that the VAA / Partner takes to prepare the order and the time of shipment to the delivery address of the order.

In the event the Customer orders several products with different delivery times and, in order to minimize shipping costs, VAA or the Partner may proceed with joint shipment of the products, within the longer shipping period.

In the event of any product being out of stock, the Customer will be informed by email regarding the new expected delivery date, and he/she may maintain or cancel the order.

6. PAYMENTS METHODS

The Customer can purchase using a card (Visa; Visa Electron; V-Pay; MasterCard; Maestro), PayPal, Klarna or MBWay.

In case of PayPal payment you can pay in a fast and secure way with your PayPal account or your credit card, without exchanging financial information with the current Casa Alegre website.

In case of payment by ATM, the reference number will be available for payment for a period of 7 (seven) days. If payment is not made within this period, the order will be automatically cancelled.

In the case of credit card payments, all transactions will be stored by the service provider for possible consultation by Redunicre.

When making payments with Klarna, we offer the option of paying in 3 interest-free instalments on purchases over €35, when payment is made through the Klarna app. When purchasing with the "pay in 3 interest-free instalments" option for the first time, Klarna will verify the identity of the buyer for the sake of personal data security.

7. CANCELLING THE ORDER

The customer may cancel the order, provided that it has not yet been processed by VAA. The cancellation of the order may be formalized by an email sent to the address online@casaalegre.com. The Customer must mention the order number and his tax identification number, under penalty of ineffectiveness of the cancellation.

8. REFUSAL OF THE ORDER

VAA reserves the right to refuse the order, in which case it will inform the Customer, given the following cases:

a) Out of stock;

b) Unavailability of the item;

c) If VAA considers that there has been misconduct by the buyer or inaccuracies in the personal data recorded.

9. RETURNS

The customer may return the product within 14 days of receiving it,with rare exceptions identified on the respective product pages. Within that same period the customer may file a complaint about any defects or inadequacy of the product compared to what was ordered.

The return should be made using the form available on the website for this purpose or by email sent to the address online@casaalegre.com, always mention the order number and his tax identification number. 

In the complaint, the Customer shall expressly indicate the reasons for complaining.

The support team of Casa Alegre site will coordinate with the Customer how to proceed with the return of the goods, if justifiable, in which case VAA will assume the costs of the return and of a new shipment.

In situations where the reasons for the return are not attributable to VAA or its Partner, the return will be accepted after checking if the pieces returned and their packaging are in good condition, followed by a refund of the amount paid by the Customer, minus the costs of return shipping, as per the values defined in the following table.

In the event that the Customer wishes to return products from different entities (VAA and Partners), multiple shipping costs will be deducted from the return, as many as the entities the products are being returned to.

Consequently, VAA and its Partners reserves the right to not accept returns of products without prior notice and/or which do not meet the same conditions of conformity as they did on the date of their delivery to the Customer (namely products that have undergone any use, transformation, damage and/or are missing the original packaging/accessories/extras). Products are assumed to have been delivered to the customer in good condition, unless packing damage to the shipping box is clearly reported by the recipient, subject to accurate, complete, dated and signed observations on the delivery document. Detailed observations registered by the customer during the act of delivery must be referred to in any claim for damage or partial loss.

10. LIMITATION OF LIABILITY

We make every effort to ensure that the information presented is free of typographical errors and whenever they occur, we proceed with their correction as soon as possible.  In case the information provided does not match the characteristics of the product, the Customer has the right to return it in accordance with paragraph 9.

The photographs presented on the site are merely illustrative. We recommend that you consult the product characteristics for detailed information.

Despite the efforts of VAA, some products may have an incorrect price, therefore we also check the prices when processing orders. If the price of the product is less than the advertised price, we will refund the difference. If the price is higher, we will inform the customer by email and await his decision as to whether or not he/she accepts the new price or if he/she wishes to cancel the order.

10.1 LEGAL GUARANTEES AND DISPUTE RESOLUTION

In the case of Partner products, which are not included in “VAA Brands”:

The Partner selling the products undertakes to grant the Customer the legally required warranties and/or other extended warranties, in accordance with the regulations and legislation applicable in Portugal and in each of the countries of the European Union (EU).

The Partner, as a producer, manufacturer or seller of the Products, will be the only and exclusive responsible before the shall be solely and exclusively liable to the End Customer, for any nonconformities, defects and/or anomalies of the products, non-compliance with legal requirements regarding quality, certification and safety of products, contingencies, delays and/or non-delivery of the products, as well as, for the provision of guarantees granted or legally required of the products, in accordance with the regulations and legislation applicable in Portugal and in each of the countries of the European Union (EU).

The Customer declares to fully understand the conditions of sale and expressly accepts that all situations related to the activation of product warranties and the resolution of any litigation, extra judicial and/or judicial, directly or indirectly related to the sale of products, including claims for indemnity, compensation, reimbursement of expenses or payment of any amounts by any means, must be submitted, requested and resolved, solely and exclusively, with the Partner selling the products, with no intervention and with total exclusion of VAA.

12. REGISTRATION AND PROTECTION OF PERSONAL DATA

When registering to use this website, we will ask the Customer to create a password. The Customer should keep it strictly confidential, not revealing nor sharing it with third parties. The Customer is entirely and exclusively responsible for the use of his/her password and any orders placed by using it, even without his/her knowledge.

In the case of registered Customers, we will collect the information required to carry out the whole sales transaction online and for future contacts that may be necessary so as to ensure the best customer service.

The Customer assures that the personal data provided is true and accurate and undertakes to notify any changes. Any loss or damage caused to the online store or a third party resulting from incorrect inaccurate or incomplete information on the registration forms will be the sole responsibility of the Customer.

The services provided by VAA will always honor the provisions of the Personal Data Protection Law - Law no. 58/2019 of 8th of August, therefore, the sole purpose of VAA regarding the Customer's personal data is the customer’s account management, billing, communication with customers, statistical analysis and direct marketing, assuming the commitment to privacy and security in the processing of personal data of each customer.

13. INTELLECTUAL AND INDUSTRIAL PROPERTY

All texts and images reproduced or represented in the Casa Alegre website are the sole property of VAA and its Partners and are, as such, strictly reserved for VAA/ Partners and protected under copyright and intellectual property rights regarding third parties.

Any reproduction or representation, whether total or partial, of the Casa Alegre website or of all or part of the elements included in it is strictly forbidden.

Trade names, trademarks or distinctive symbols reproduced in the Casa Alegre website are protected under the laws applicable to industrial property. The reproduction or representation of all or part of any distinctive symbol is strictly forbidden. Reproduction or representation of all or part of any distinctive signs is strictly prohibited.

14. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions for online shopping in the Casa Alegre website are governed by Portuguese legislation.

The parties agree that any disputes that may arise from the interpretation and/or application of these Terms and Conditions that cannot be resolved through friendly negotiations shall be submitted to the exclusive jurisdiction of the head office of the VAA, expressly waiving any other.

By using the online store, the Customer accepts and agrees with these Terms and Conditions and the Privacy Policy and Personal Data Protection.
